26 - 1 - 04: The New Mental Health ActSource: SAMH The Mental Health (Care and Treatment) (Scotland) Act 2003, was passed by the Scottish Parliament in March 2003. It came into effect in April 2005. The Scottish Executive is working on a Code of Practice, and other guidance, to give people more detail about how the Act will work in practice. It is important that the views of service users and carers are taken into account in developing the Code of Practice and other guidance. The new Act covers issues like: • when can you be taken into hospital against your will • when can you be given treatment against your will • what your rights are • safeguards to make sure your rights are protected. |
